The following Sample Student Training Contract or Agreement is a guide. Which party actually assumes the various responsibilities must be agreed upon by the two parties and reflected in the Student Training Contract or Agreement.

This agreement is entered into this (20th) day of (May), 19(97), effective the (1st) day of (July), 19(97), between the (Smith County Hospital), hereinafter referred to as "SCH" and The Board of Regents, Governing Body for the University of Nebraska Medical Center, College of Nursing, hereinafter referred to as "UNMC."

PURPOSE

The common objective of both parties is to provide a clinical experience for students in the (College of Nursing) at UNMC. The parties agree that SCH will permit a mutually agreed number of students to affiliate with SCH for a period of time determined by UNMC to provide (Nursing) services to SCH patients under supervision provided by UNMC.

TERM

This agreement is for (1 year) from the effective date of this agreement. The agreement may be renewed annually by consent of both parties.

(Alternate)

This agreement is for a term of one year and shall be automatically renewed unless terminated.

Either party may terminate the agreement upon (60) days prior written notice to the other party provided that no termination shall be effective until completion of the semester currently in progress at the time the (60) days notice is given.

COMPLETE AGREEMENT

The parties mutually agree that this written document represents the complete agreement of both parties concerning the terms hereof and that any change in terms must be contained in writing duly executed by both parties.

RIGHTS AND RESPONSIBILITIES OF SCH

Facilities: SCH shall provide reasonable use of such of its facilities as are necessary to provide clinical experience; including use of the Medical Library, classrooms and conference rooms.

Scheduling of Students: SCH shall have responsibility for planning and preparing the schedule of the educational experience of the students and shall provide UNMC with advance notice of changes in staffing level, staffing patterns, patient load and changes in policy that may affect the clinical education of students.

Suspension of Training Privileges: SCH shall retain the right to terminate the use of its facilities, equipment or supplies by any student or faculty member where flagrant or repeated violations of SCH's rules, regulations, policies or procedures occur. Such action shall not normally be taken until the grievance against any student or faculty member has been discussed with the appropriate representative of UNMC. SCH reserves the right to take immediate action where necessary to maintain operation of its facilities free from interruption.

RIGHTS AND RESPONSIBILITIES OF UNMC

Professional Liability Insurance for Employees and Students: UNMC shall maintain, at its own expense, professional liability insurance or self insurance coverage in the amount of $200,000 per occurrence and $1,000,000 in the annual aggregate of not less that $1,250,000 through a combination of insurance and qualification under and participation in the Nebraska Hospital-Medical Liability Act covering employees and students (including house officers) of Provider for claims under the Nebraska Hospital-Medical Liability Act for bodily injury or death on account of alleged malpractice, professional negligence, failure to provide care, breach of contract, or other claim based upon failure to obtain informed consent for an operation or treatment.

Professional liability insurance or self insurance in the amount of $1,000,000 per occurrence and $1,000,000 in the annual aggregate covering employees and students (including house officers) of Provider for claims not falling under the Nebraska Hospital-Medical Liability Act for bodily injury or death on account of alleged errors or omissions or negligent acts in the performance of professional services rendered or that should have been rendered.

Education and Supervision: UNMC is responsible for the academic aspects of the learning experience of its students in all areas of curriculum.

Administration: A mutually agreed upon number of students shall participate, not to exceed (10) students. UNMC shall select and provide SCH with the names of students enrolled (10) days before each academic term begins. UNMC shall be responsible for providing instruction, supervision and evaluation of students.

Adherence to SCH's Rules and Regulations: UNMC shall require its students and faculty to adhere to SCH's rules, regulations, policies and procedures while on the premises.

MUTUAL AGREEMENTS OF PARTIES

Patient Welfare: The parties mutually agree to reasonably cooperate to assist the students in completing their training consistent with SCH practices to insure adequate care and treatment of patients.

Expenses: The parties agree that each party shall be responsible for costs or expenditures incurred except as may be agreed upon by the parties in this agreement or in a separate memorandum attached hereto.

Equal Opportunity Compliance: Neither SCH nor UNMC shall discriminate against any employee, applicant or student for employment or registration in its course of study because of race, color, religion, sex, national origin, handicap or Vietnam era status. Both parties agree to comply with the Educational Rights & Privacy Act of 1974 governing the privacy of student records.

Hold Harmless: To the extent permitted by law, SCH agrees to indemnify and hold UNMC from any and all costs, expenses, claims demands, causes of action, liabilities and responsibilities arising out of or in any way connected with any act or omission of UNMC's employees and students.

Accidental Exposure to Patient Blood or Bodily Fluids: The parties mutually concur with the Centers for Disease Control Statement that there is risk for accidental exposure to blood or bodily fluids for students in health profession education programs. SCH shall have in place an Accidental Exposure to Patient Blood or Bodily Fluids Policy. This policy shall include the following terms and any other terms mutually agreed upon by both parties: responsibility for securing permission and blood sample from the patient for testing, responsibility for cost of blood testing, policy for student emergency care and medications. The student is responsible for obtaining follow-up care and is liable for the expense. A report of any occurrence of an accidental exposure involving students or faculty shall be forwarded to the appropriate academic unit at SCH. SCH shall also have in place a policy which describes the required immunizations for students and faculty.

In the event of illness or injury, SCH will provide emergency medical care to students and faculty. The cost will be charged to the student or faculty member. UNMC will be notified and provide appropriate follow-up care.

IN WITNESS THEREOF, the parties have executed this Agreement as of the day and year written above.
