UNMC Procedural Rules Relating to Student Discipline


Purpose

Provides the mechanism for formal student appeal of any disciplinary action brought against the student or resolves a grievance submitted by the student.

Scope

Applies to undergraduate and professional graduate students. PhD students will utilize the mechanism provided by Graduate Studies.

Functions

  1. Serve in accordance with UNMC and CON rules, regulations and policies.
  2. Review formal disciplinary appeals and formal grievances for further investigation and hearings.
  3. Create hearing committees in response to student disciplinary appeals and grievances.
  4. Hear the disciplinary appeal or grievance to determine appropriate action and outcomes.
  5. Notify appropriate parties regarding hearing committee outcomes.
  6. Responsible for recording outcomes in the student success platform.
  7. Annually review disciplinary appeals and grievances policies and procedures.
  8. Provide annual grievance report to appropriate committees and Associate Dean for Academic Programs (ADAP).

Membership

  1. The chairperson (or co-chairs), is/are elected annually by the committee members. The chair (or co-chairs) must be a faculty member. The chair (or at least one co-chair) shall have served a minimum of one (1) year on the committee. The chair-elect for the following year is elected annually by the committee members. The chair elect shall have served a minimum of one (1) year on the committee.
  2. Fifteen faculty members will be selected by vote from General Faculty Organization (GFO) for three-year terms.
    • Two undergraduate faculty from each division
    • Five professional graduate faculty representing any division.
  3. One student representative from each division (volunteer, non-voting) for a 1-year term
    • At the beginning of each academic year, one undergraduate student who is in good standing will be selected representing each of the five divisions to serve
    • 5 professional graduate students.
  4. The dean, ADAP, program directors, and division assistant deans are ineligible to sit on this committee.
  5. Names of Disciplinary Appeals and Grievance Committee (DAGC) members are submitted by the dean to the chancellor’s office at the beginning of the academic year. Changes in membership shall be promptly communicated to the chancellor’s office.
  6. No student and no more than two faculty members may serve on both the DAGC and the Academic Review Committee.

Hearing Committee Membership

  1. Each hearing committee will consist of five members – three faculty and two students of the DAGC.
    • The three faculty members will not be a member of the division or specialty in which the disciplinary action or grievance originated.
    • Students must represent a different campus.
    • The chair will determine any conflict of interest with any faculty or students serving on the hearing committee.
  2. In addition, the appropriate program director will serve as the conduct officer for hearing committees. The conduct officer is not a voting member of the hearing committee and is not an elected position. Any other program director can function as a designee if needed.

Guidelines

  1. The judgements of the DAGC and each hearing committee will be in conformity with the UNMC and CON policies.
  2. Disciplinary appeal hearings will be conducted according to the procedures in Appendix K.
  3. Grievance hearings will be conducted according to the procedures in Appendix W2.
  4. Hearing committee proceedings will be conducted confidentially.
  5. Each hearing committee will determine a faculty member to serve as chair.
  6. Each member of the DAGC will have one vote in the hearing committee decision.
  7. The committee will meet at least semiannually during the academic calendar year.
